Can AI Prompts Be Patented?

Recent discussions in AI and patent law have raised a unique question: Can the prompts used in AI systems, like those for large language models (LLMs), be patented?

Patenting an AI prompt, such as instructions for designing a specific product, could potentially cover a broader range of inventions than a patent for a single AI-generated product.

A patentable prompt might describe general features of a device or process, which an AI then elaborates into detailed descriptions.

But what makes something patentable?

An invention must be novel, non-obvious, useful, and enable a skilled person in the field to recreate it without excessive experimentation.

AI prompts, describing a class of inventions, could potentially meet these criteria.

Consider different types of prompts:

  1. Specific Product Designs: A detailed prompt for a unique, useful, and nonobvious device.

  2. Pseudo-code for Algorithms: A prompt that, when processed by an AI, generates executable code for a patentable algorithm.

  3. Process Descriptions: A prompt outlining a new, efficient method for a technological process.

  4. General Classes of Devices: More abstract, these prompts define broad categories like energy-efficient engines.

  5. Open-Ended Concepts: Very abstract prompts that pose broad questions or concepts.

Each type of prompt presents varying levels of patentability, from concrete designs to more abstract ideas.

The key question is whether these prompts, through AI interpretation, can produce clear, actionable results fulfilling patent law's requirements.

Critics argue that patenting prompts could stifle innovation, echoing concerns from historic patent cases. However, proponents believe that prompt patents align with traditional patent claims and could convey protection scope clearly and concisely.

'Assistant with Bard' is designed to be a more personalized helper, seamlessly integrating with popular Google products & services like Gmail, Docs, and Android devices.

Imagine planning your next trip, sorting through your emails, creating a grocery list, or even composing a text, all facilitated by your digital assistant just by saying “Hey Google”.

One of the striking features showcased is the conversational overlay on Android devices. 

For instance, if you snap a photo of your pet, "Assistant with Bard" can overlay on the image, understanding the context and assisting in tasks like crafting a social media post - a new and engaging way to interact with your phone.

A notable addition is the integration of this AI assistant into the Google Search app's Discover page, hinting at a more interconnected Google ecosystem.

Moreover, a new Bard setup prompt encourages users to upgrade their Assistant with AI features, emphasizing the ease and versatility of this new tool.

While I’m not an Android user myself, I do love the Google Search app, and would love to see Bard integrated efficiently into Google Lens and other products.
