The Bite: Musk’s xAI just decided to take their recent claims to court.

xAI claims that Apple and OpenAI have colluded on iOS App Store placement, favoring ChatGPT above other AI apps… (isn’t it the most popular though…?)

Musk also claims that ChatGPT is the only “native” AI for iPhone’s Siri creates and unfair “anticompetitive scheme.”

Unironically, we reported yesterday Apple’s in talks with Google to potentially bring a custom Gemini model to the iPhone.

Snacks:

• Claims: 10 counts: Sherman Act §1/§2, conspiracy, unfair competition, Texas antitrust.

• Elon: ‘ChatGPT is the only native iOS AI; App Store lists de-ranked Grok/X’

• OpenAI: This is just part of Musk’s “…ongoing pattern of harassment.”

• Don’t forget that Musk and Altman have been publicly throwing punches for a while now. 👇

Why it Bites: First off, we have to recognize that whatever your opinion on Elon is, he’s certainly good at staying in the news cycle.

Is ‘all press is good press’ still true in 2025?

We’ll be following this story closely and we don’t have an opinion of who’s right or wrong here.

But what we do know: If a CEO gets his way, after kicking and screaming, the future is cooked.

ChatGPT has been at the top of the App Store because it’s basically the most popular consumer app in the world.

Over 8.5% of all humans use ChatGPT.
Meaning: “DUH. OF COURSE IT’S ALWAYS AT THE TOP OF THE APP STORE!”

The Bite: Meta is licensing Midjourney’s “aesthetic tech” and linking research teams so Meta AI (and FB/IG/WhatsApp creative tools) can spit out prettier images and eventually video without buying MJ.

No timelines, no dollars, no exclusivity.

Midjourney stays “indie” for now..

Expect image upgrades first, with video riding shotgun as MJ’s early image-to-video work matures.

Yes, we’re a couple of days late on this.
Yes, we’re also happy Zuck didn’t buy MJ.

But we bet he tried...

It’s kinda funny that Midjourney, our favorite image gen platform, the one famous for training on copyrighted work without asking, just inked a licensing deal of its own…

And the timing couldn’t be more ironic.

They’re actively being sued by Disney and Universal for… you guessed it… not licensing stuff.

And now MJ has Zuck in their corner.

Disney/Universal isn’t battling a solo indie company anymore; Meta now has direct incentive for MJ to win that lawsuit.

The lawsuit still matters.
But the leverage has shifted.

Zuck, the distribution king, just stepped in the ring.
